Good day, I am Jonathan Mance. Lord Mance. Recently retired as Deputy President of the United Kingdom’s Supreme Court. But I am speaking to you today from 7 King's Bench Walk, in the Temple, in London.
各位好，我是Jonathan Mance，Mance勳爵。最近剛從英國最高法院副院長的職位退休。我今天在位於倫敦聖殿的7 King's Bench Walk大律師事務所與您交談。
I was a barrister here, before I became a Judge in 1993 and I have returned here since retirement in order to do some arbitration and some expert witness work.
在1993年我成為一名法官之前，我是這裡的大律師，我退休後回到這裡，以便從事一些仲裁和專家證人的工作。
I send greetings across the world, to Zhiku and to the arbitration community in China, on the Chinese New Year.

Arbitration has proved a hugely popular method of dispute resolution. Its consensual element corresponds to what I believe is the desire of commercial people, as far as possible, to regulate their own affairs and the New York convention underpins its enforceability.

When I was a barrister, I saw a considerable amount of commercial arbitration. But since my retirement, I have also seen a newly developed form of arbitration, newly developed while I was on the bench, and that is investment treaty arbitration.
當我是一名大律師時，我看到了相當數量的商事仲裁。但是自從我退休以來，我也看到了一種仲裁發展的新形式，這是仲裁在我任職最高院法官期間的最新發展，那就是投資條約仲裁。
Although arbitration is popular in these and other areas, it is wrong to be complacent and we should all be considering how arbitration can best fulfil, what I also believe, are the wishes of the community of its users. And that is that it should take place speedily, efficiently and at a reasonable cost.
儘管仲裁在這些領域和其他領域都很受歡迎，但是我們不應自滿，我們都應該考慮仲裁如何能最好地，我相信這也是客戶們的願望，那就是讓仲裁以合理的成本，快速、有效地進行。

Mance勳爵簡介
Mance勳爵自1966年開始就以大律師身份（barrister）在英國倫敦頂尖的國際商事大律師事務所7 King's Bench Walk（7KBW）執業。Mance勳爵於1993起開始其法官生涯，擔任英國高院法官，並於1999年至2005年期間擔任英國上訴法院法官。在2005年至2009年期間，Mance勳爵為英國上議院（House of Lords，英國最高法院前身）法官。自2009年英國建立最高法院開始，Mance勳爵就一直擔任英國最高法院法官，並在2017年至2018年期間擔任英國最高法院副院長。
Mance勳爵在銀行、公司、信託、國際私法、合同法、歐盟法、人權法、國際公法、保險、海事海商等領域具有豐富的經驗，其處理的諸多案件均成為英國法下的經典判例，被後人反覆援引。在這些經典判例中不乏與仲裁相關的案件，涉及仲裁庭的管轄權、國家主權豁免、仲裁裁決的執行、禁訴令、財產擔保、針對仲裁裁決的上訴、雙邊投資條約仲裁等事項。
目前，Mance勳爵從英國最高法院退休，回到7KBW再次以大律師的身份從事仲裁及專家證人的工作。
