Apple Night Shift 商標註冊可能被誤讀
Patently Apple 最近報導了蘋果將 Night Shift 進行商標註冊一事。但很多媒體將其誤讀成蘋果可能要把「夜間模式」推廣到 Mac、手錶和 CarPlay 上。但 9to5 Mac 今天指出,這只是商標註冊的基本流程之一,在 Night Shift 商標註冊的設備列表上,除了蘋果自己的硬體、軟體之外,還有包括電腦數據線、觸控筆、耳機、充電器甚至滅火器等等。蘋果完全有可能將「夜間模式」應用到所有系統上,但商標註冊並不是蘋果這一動作的標誌。
暴雪起訴製作《守望先鋒》外掛公司
暴雪公司將製作《守望先鋒》外掛的 Bossland 公司告上法庭,指控對方以多種形式侵犯版權以及不正當競爭。
《守望先鋒》是暴雪最近推出的第一人稱射擊遊戲,上線之後銷量喜人,獲得一致好評。但部分玩家在遊戲中使用了 Bossland 公司開發的 Watchover Tyrant 外掛。
暴雪將德國 Bossland 公司告上了加州聯邦法院,並在訴狀中也包括了 Bossland 為暴雪其他遊戲製作的外掛。暴雪指控對方有多種形式的版權侵權,以及不正當競爭,並違反了《數字前年版權法案》的反規避版權保護條款。
暴雪稱這些外觀已經給其造成了百萬美元的損失,並且讓很多遵守遊戲規則的玩家受害。
被告在美國境內的對作弊軟體的銷售和分發給暴雪公司造成了數百萬至千萬美元的損失,並在誠信和聲譽上遭受到了無法彌補的損害。在《守望先鋒》遊戲上線幾日後就發布「守望先鋒作弊軟體」,被告正在嘗試在一個遊戲還沒完全釋放潛力時就給它造成無法彌補的傷害。
用戶通過全景視頻將盜版電影上傳至 YouTube
YouTube 的 Content ID 系統可以通過比對,檢測用戶是否上傳的侵權視頻內容,如果匹配,系統則會自動刪除視頻。但最近一個叫做 Thuy Pham 的用戶通過上傳一個 360 度全景視頻,將 1995 年的電影《獨領風騷》嵌在了視頻內部成功發布。目前該視頻已經被 YouTube 刪除,但是尚不知道 YouTube 是否對這種新形式的盜版開發出了新的檢測方式。
豐田欲註冊飛行汽車專利
日本車商豐田提交了一份可為飛行汽車使用的變型車身專利。專利申請中寫道「一輛可以在地面模式駕駛,也可以作為飛機起飛、飛行和降落的汽車」。專利提交於 2014 年年底,美國專利與商標局在上月 23 日公開了這項專利。
這輛汽車的設計沒有掀背式後備箱,而是一個背後螺旋槳,這可能是汽車在飛行時的動力來源。在地面時,汽車的兩翼將收在車身下方。這可能是專利設計中有可拉伸車皮的變型車身的原因。

A misleading headline on Patently Apple is already leading to speculation that Apple may be planning to bring its Night Shift feature to Macs, the Watch and CarPlay. None of this is impossible, but Apple’s trademark certainly doesn’t 『hint』 at this.
Night Shift is the feature, introduced with iOS 9.3, that adjusts the white balance of displays toward warmer colors toward the end of the day. The theory is that this helps keep our circadian rhythm in tune with natural light, and promotes better sleep.
The 『evidence』 that Apple may plan to bring the feature to other devices is pulling out specific wording from a trademark application. The problem with this is, as Patently Apple notes right at the end of the piece, that this is just standard trademark wording, not anything specifically drafted for Night Shift.
Among the many other devices listed are such things as computer cables, styluses, radios, earphones, batteries, chargers, bags, integrated circuits and … fire extinguishers.
BLIZZARD SUES OVERWATCH 「CHEAT」 MAKER FOR COPYRIGHT INFRINGEMENT
Blizzard Entertainment is suing Bossland, the maker of the popular Overwatch cheat tool "Watchover Tyrant" and several other game cheats. Among other things, the developer accuses the German company of various forms of copyright infringement and unfair competition.
「Overwatch,」 which became an instant bestseller. The game received rave reviews and generated hundreds of millions of dollars in revenue during its first weeks on sale.
While most Overwatch players stick to the rules, there’s also a small group that tries to game the system. By using cheats such as the Watchover Tyrant, they play with an advantage over regular users.
Blizzard is not happy with the Overwatch cheat and has filed a lawsuit against the German maker, Bossland GMBH, at a federal court in California. Bossland also sellscheats for various other titles such as World of Warcraft, Diablo 3 and Heroes of the Storm, which are mentioned in the complaint as well.
The game developer accuses the cheat maker of various forms of copyright infringement, unfair competition, and violating the DMCA’s anti-circumvention provision.
According to Blizzard these bots and cheats also cause millions of dollars in lost sales, as they ruin the games for many legitimate players.

YouTube has gotten very good at figuring out when people upload copyrighted material to the video-streaming site, and taking things down. Its program, Content ID, matches videos from the site against a database of video uploaded by content owners. If there’s a match, YouTube will move to take that video down.
An ingenious pirate, going by the name Thuy Pham on YouTube, managed to embed the entirety of the 1995 classic Clueless inside a 360-degree video. At first, it seems like you’re just watching the Alicia Silverstone vehicle as you would any other video on YouTube—albeit slightly sped-up—but if you move the video around, you』ll see that it’s actually injected into what appears to be some sort of dance studio, replete with three women facing away from the movie.
Toyota wants to patent a ridiculous flying car
The Japanese car manufacturer has submitted a patent application for a shape-morphing fuselage for an aero car. It wants to create 「a vehicle than can be both driven on the road in a land mode and takeoff, fly, and land as an aircraft in a flight mode,」 according to the application, which Toyota filed in December 2014. The US Patent and Trademark Office (USPTO) only made public on June 23, 2016.
Instead of a typical coup-style or hatchback, the flying car will have a propeller on its back, likely meaning the car will operate with a rear motor. When grounded, the wings will be stowed underneath the body panels—that’s why the design shows the shape-shifting fuselage with tensile skin.
