未成年學生申請加拿大學習籤證:監護公證到底需要不需要做啊?
最近很多代理和學生家長懷著十分複雜的心情問我:未成年學生申請加拿大學習籤證:監護公證到底需要不需要做啊?
雖然是通過QQ或者電話聯繫,但是我能感覺到他們的焦慮和煩惱。我如下囉嗦了很多東西,其實一句話,能做,你就做,省著麻煩和焦慮。我歷來如此的保守。
我還是給大家科普一下吧。這個事情說起來,有點複雜,我慢慢道來。

第一頁是加拿大的監護人同意接受學生父母的委託,將作為監護人承擔起相應的責任。這個需要在加拿大的律師那裡做公證。
第二頁是學生的父母同意委託某某人作為孩子在加拿大的監護人。這個需要在國內的公證處做公證的。

這個監護信誰要求學生和家長提供?
首先,當然是學校要求提供。加拿大的各個省對成年的年齡的定義略有不同,有的規定滿18周歲即為成年,有的省規定滿19歲才為成年人。因此,如果要去讀中小學,那是必須做監護公證的,這是加拿大的學校或者教育局的要求。如果是去學院或者大學讀書,則各個學校根據情況,原則來說,滿17周歲則無需做監護公證,不滿17歲則必須做監護公證。(下面討論滿17周歲卻不到成年人年齡的情況如何處理)
其次:在遞交加拿大籤證申請的時候,加拿大使館要求提供。加拿大使館也是根據加拿大各省對於成年的要求,決定學生是否需要做出公證。但是加拿大移民部有最新的要求,針對那些滿17周歲,但是還沒達到各省的對於成年的年齡的學生,則有不同的要求:去讀中學,必須做監護公證,去讀學院或者大學則不強制要求做。

在加拿大籤證申請中心提供的文件清單中,還是這樣說的:
下列申請人需要來自於父母及加拿大監護人的監護聲明:18 歲以下且就讀學校位於阿爾伯塔省、薩斯喀徹溫省、曼尼託巴省、安大略省、魁北克省、或愛德華王子島省;或 19 歲以下且就讀學校位於卑詩省、紐布朗斯維克省、紐芬蘭省、新斯科舍省、西北領地、努納武特地區或育空省。
之前和現在都有很多學生去加拿大洛基山學院讀書,年齡是滿17周歲不到18或者19周歲,請求學院辦理監護公證,學院根據加拿大公民和移民部的官方文件和過去的經驗,建議滿17周歲的學生無需辦理複雜的監護公證。未滿17周歲的學生需要做監護公證。按照學院的安排,滿17周歲的學生都沒有做監護公證,都順利獲得籤證,順利在加拿大海關通關,也順利入學。
當初我們也對17-19歲之間的申請人是否需要做監護公證的事情,猶豫、糾結而且抓狂,而後接到學院領導的如下答覆,也就釋然了。乾脆不做!俺們領導是這麼說的:

關於是否需要做監護公證,對於年齡的要求,以哪個時間點為準?
使館如果需要學生提供監護公證,則通常來說,是按照學生遞交籤證申請的時候的年齡來決定是否需要做監護公證的。
加拿大的教育局和各個中學,無論年齡多大,基本都要求做監護公證的。即使在糾結是否為成年人的時候,是按照入學的時間來計算年齡,決定是否要求做監護公證的。
由於籤證遞交的時間和實際入學的時間是有幾個月的差別的,因此,要正確理解這個時間的問題。

誰有權做學生在加拿大的監護人?
首先,在各個省必須是當地認定的「成年人」,成年人必須是
加拿大的公民或者
永久居民
這些人才有權做監護人

誰來負責做加拿大的那份監護公證書:
加拿大的學校可以指定學校領導為監護人,可以直接找個律師把監護信公證
加拿大的寄宿家庭管理公司,可以協助安排公司的領導為監護人,並提供寄宿家庭的相關服務。
如果學生自己堅決要求自行解決,則學生的父母在加拿大的親人或者朋友,符合條件的,可以指定一個親友為監護人,去律師那裡做一份監護公證。

學生的父母在國內做這份監護公證,注意事項如下:
赴加拿大讀書的學生國內監護公證辦理注意事項
學生要根據加方的監護信的信息,填寫加拿大移民部指定的表格[CustodianDeclaration IMM 5646]的第二頁,做國內的監護信的公證件。填寫好以後,列印2-3份,帶到公證處。
學生的父母要帶著身份證原件,一同去公證處,當著公證員的面,在監護人聲明上signatureof parent/guardian的上方籤字[中文籤字,比如: 李辰,範冰];然後寫明日期,日期的寫法請注意:順序為年,月,日,比如: 2016 02 16 ;然後即可公證.
有的公證處要求把這個監護聲明翻譯成中文,然後把中文翻譯放到公證書裡,其實大可不必,因為這個聲明是給加拿大人看的,翻譯成中文,沒有意義。如果實在要求翻譯為中文,那你只好多繳費了。
只要證明是學生的父母在公證員的面前,親自在前面的監護聲明上簽字,即可。
加拿大的學校和加拿大使領館有的時候比較嚴格,要求公證員也在這個英文版的監護信上簽字,證明公證員見證了籤字儀式。因此,儘量與公證員溝通好,在確切了解監護信的內容的前提下,最好在頁尾的公證員籤字的地方籤字,在籤字的上方寫上確切的時間和地點。
有的公證處需要提供指定的國外的監護人的護照或其他身份證件的複印件備案。因此,請向加拿大的學校索要加拿大監護人的護照的掃描件。

監護公證必須提供原件嗎?
實際上,加拿大使領館只是需要國內外的2份監護公證的複印件,掃描錄入移民部的信息備案即可。
因此,加拿大的那份監護公證的原件,可以不必提供原件,這樣可以節約郵寄的時間。建議學生接到加拿大的那份監護公證後自己留存,即可。
在國內做的這份監護公證,原件,可以隨同其他資料一起遞交給加拿大使館。
所以提交籤證申請的時候,提供國內外的監護信的複印件 + 國內的監護公證書的原件 + 國外的監護公證的原件(若有)

專家的建議:
如果你對是否做監護特別的糾結,特別是那些處於17-19歲的申請人,我建議你可以都做好監護公證,因為,一共也沒有多少時間,也沒有多少費用。
如果使館要求你補充監護公證,則你要至少往返2-3個星期,才能做好並且提交上去,這樣大大延緩了獲得籤證的時間。

Summary
Effective September 15, 2011, the custodianshiprequirement will be discretionary for minor students between 17 years of ageand the age of majority in the province or territory of the educational institutionwhere they intend to study. The custodianship requirement will continue to bemandatory for minor children under the age of 17.
Issue
This Operational Bulletin (OB) is to inform officersthat the mandatory custodianship requirement has been changed for certain minorchildren coming to Canada to study.
Background
The custodianship requirement assures the immigrationofficer that adequate arrangements for care and support of a minor child, otherthan social assistance, have been made. While custodianship is not a specificrequirement of immigration legislation, it supports the determination that aminor is not inadmissible to Canada for financial reasons.
1. Current Guidelines
Section 5.16 (Custodianship) ofthe 「OP12 Manual [PDF format, 350 Kb]」 states:
「To satisfy A39 [Inadmissibility, Financial Reasons], all minor applicantsmust supply a notarized declaration, one signed by the parents or legalguardians in the country of origin, as well as one signed by the custodian inCanada, stating that arrangements have been made for the custodian to act inplace of a parent.」
Minor children are defined asthose who are under the age of majority, as set out by each province or territoryat the time of their arrival in Canada.
2. Revised Guidelines
a. Mandatory Custodianship Requirement (under 17years of age)
If a minor student is less than17 years of age at the time of application, a custodian in Canada will continueto be required. The applicant must submit a notarized declaration signed by theparent(s) or legal guardian(s) in the country of origin, as well as one signedby the custodian in Canada, stating that arrangements have been made for thecustodian to act in place of a parent. Officers must be satisfied that adequatearrangements are in place for the care and support of the minor student. Theparent(s) or legal guardian(s), and the appointed custodian must acknowledgethat the custodian will reside within a reasonable distance to the minorapplicant’s intended residence and school. The custodianship declaration shouldinclude the information and signature of both parents, where applicable.
b. Discretionary Custodianship Requirement (17 to 18or 19 years of age)
Applications from minors between 17 years of age andthe applicable provincial/territorial age of majority at the time ofapplication should be assessed on a case-by-case basis. In assessing whetherthe custodianship requirement should be applied, officers may exercisediscretion in requesting additional documentation or an interview. An officer shouldbe satisfied with respect to whether an applicant can provide care and supportto oneself while in Canada. Officers should consider factors such as:
Level of studies – applicant’s intended level of academic studies. Those attending secondary school should normally require a custodian.
Level of independence – applicant’s current or past living arrangements and whether previous studies were completed away from their principal residence.
Financial capacity – applicant’s financial self-sufficiency outside of parent(s)/guardian(s) (i.e., scholarship, government sponsored, etc.).
Travel experience – applicant’s previous travel history, participation in international exchange programs, etc.
Accessibility of parent(s)/guardian(s) – location of applicant’s parent(s) or guardian(s) and their accessibility for institutions and/or medical centres to contact them in case of emergency situations.
Informal arrangements – whether arrangements (less formal than custodianship) have been made to provide support and care for the minor student.
Risk environment – applicant’s safety and well being in relation to risk indicators for irregular child migration, and potential for exploitation and/or trafficking.
3. Electronic Application System
The electronic application systemhas been modified to implement the above policy change. Applicants wishing toextend their student status in Canada and overseas study permit applicants underthe Visa Exempt Study Permit Abroad (VESPA) pilot project will be requiredto provide the custodianship declaration if they are under the age of 17 at thetime of their application. Those applicants who are between 17 and the age ofmajority, at the time of application, will still be asked if they will beliving with their parent(s) or legal guardian(s) while in Canada; however, theywill not be asked to provide the custodianship declaration. Officers mayrequest the custodianship declaration of any applicant at their discretion.
4. Minor students destined for QuebecMinor students destined forQuebec must continue to apply for and be approved for a Certificat d』acceptation du Quebec (CAQ)before entering Canada. Those under 18 years of age requirea custodianship in order to obtain a CAQ. For moreinformation,
