《中華人民共和國刑法》規定
Article 260(A) If any person who is responsible for guardianship or for taking care of a person who is minor, aged, sick or disabled, etc. maltreats the person under his guardianship or care and the circumstances are serious, the person who commits the maltreat shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.
第二百六十條之一 對未成年人、老年人、患病的人、殘疾人等負有監護、看護職責的人虐待被監護、看護的人，情節惡劣的，處三年以下有期徒刑或者拘役。
Where an entity commits any of the crimes mentioned in the preceding paragraph, a fine shall be imposed on the entity, and the persons who are directly in charge of the entity and such other persons who are directly responsible for the crime shall be punished respectively in accordance with the provisions of the preceding paragraph.
單位犯前款罪的，對單位判處罰金，並對其直接負責的主管人員和其他直接責任人員，依照前款的規定處罰。
Whoever commits any of the acts mentioned in the first paragraph, which concurrently constitutes another crime, shall be convicted and punished in accordance with the provisions on heavier punishment for such crime.
有第一款行為，同時構成其他犯罪的，依照處罰較重的規定定罪處罰。
