根據我國《刑法》第一百一十條的規定，間諜罪是指參加間諜組織或者接受間諜組織及其代理人的任務，或者為敵人指示轟擊目標的行為；根據刑法的規定，間諜罪是行為犯，並不以實際上發生法定的危害結果作為犯罪成立的要件，只要實施了間諜行為，即構成本罪。
《刑法》
第一百一十條 有下列間諜行為之一，危害國家安全的，處十年以上有期徒刑或者無期徒刑；情節較輕的，處三年以上十年以下有期徒刑：
（一）參加間諜組織或者接受間諜組織及其代理人的任務的；
（二）為敵人指示轟擊目標的。
本罪所侵害的客體，是中華人民共和國的國家安全。即人民民主專政的國家政權和社會主義制度。國家安全是主權國家獨立自主地生存和發展的保障，關係國家存亡的大事，世界上無論哪一個國家，都是將維護國家安全擺在首位，以鞏固自己的政權。國家的長治久安和繁榮昌盛都是以國家安全得到保障為前提的，一些國家的滅亡、政權的喪失，也都是因為國家安全不能得到保障。因此，沒有國家安全，就沒有社會主義現代化建設和人民的一切。
